PUSH MOBILITY
TERMS OF SALE & WEBSITE TERMS OF USE
Effective date: 31 August 2026 Push Mobility Pty Ltd (ABN 64 161 571 115) ("Push Mobility", "we", "us", "our")
1. Agreement to these terms
1.1 These Terms of Sale ("Terms") apply to every quote, order, purchase, hire, trial, repair or service arrangement you enter into with Push Mobility, whether made in person, by phone, by email, or through our website, and to your use of our website generally.
1.2 By placing an order, accepting a quote, signing a delivery docket, or using our website, you agree to be bound by these Terms. If you are acting on behalf of another person — for example as a parent, guardian, carer, support coordinator, plan manager, or other representative — you confirm that you have the authority to do so and that these Terms bind both you and the person you represent.
1.3 If you do not agree to these Terms, please do not place an order or use our website.
1.4 We may update these Terms from time to time. The version in force at the time you place an order is the version that applies to that order. The current version will always be available on our website with its effective date shown above.
1.5 These Terms should be read together with our Privacy Policy, which explains how we collect, use, and disclose personal and health information.
2. Nothing in these Terms limits your consumer guarantees
2.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
2.2 Nothing in these Terms is intended to exclude, restrict or modify any right or remedy you have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded, restricted or modified. Where any clause in these Terms would otherwise have that effect, it is limited to the maximum extent the law allows, and no further.
2.3 Where permitted by law (including under section 64A of the Australian Consumer Law, for goods or services that are not of a kind ordinarily acquired for personal, domestic or household use or consumption), our liability for failing to meet a consumer guarantee is limited, at our option, to:
-
replacing the goods or supplying equivalent goods;
-
repairing the goods;
-
paying the cost of replacing the goods or of acquiring equivalent goods; or
-
paying the cost of having the goods repaired,
or, for services, to supplying the services again or paying the cost of having the services supplied again.
3. Quotes and orders
3.1 Quotes provided by Push Mobility are valid for the period stated on the quote or, if no period is stated, for 30 days from the date of issue. Prices are subject to change without notice after a quote expires.
3.2 A quote is not an offer capable of acceptance and does not bind Push Mobility to supply goods or services until we confirm your order in writing (including by email) or you pay a deposit where required.
3.3 We reserve the right to accept or decline any order at our discretion, including where a product is unavailable, mispriced, unsuitable for your stated needs, or where funding approval cannot be confirmed.
3.4 Custom, prescribed or made-to-order equipment (including custom seating, positioning, or configured mobility equipment) is built to the specifications, measurements, and information provided by you, your representative, or your treating health professional. You are responsible for checking that this information is correct before we proceed with manufacture. Once manufacture of custom equipment has commenced, the order generally cannot be cancelled — see clause 8.
4. Pricing and payment
4.1 All prices are in Australian dollars and, unless stated otherwise, include GST where applicable.
4.2 We take reasonable care to ensure prices are accurate, but errors can occur. If we discover a pricing error before your order is fulfilled, we will contact you to confirm the correct price before proceeding, and you may cancel the order if you do not wish to proceed at the correct price.
4.3 Payment is due as set out in your quote or invoice. We may require a deposit before commencing work on custom or prescribed equipment, and full payment prior to delivery or hire commencement, unless otherwise agreed in writing.
4.4 Where your equipment is funded in whole or in part through the NDIS or another funding body, payment terms will depend on the funding arrangement. You remain responsible for any shortfall not covered by your funding, and for providing accurate and current funding information. Delays or issues with funding approval may delay your order and are outside our control.
4.5 If payment is not received by the due date, we may charge interest on overdue amounts at a commercially reasonable rate, suspend supply of further goods or services, and engage a third party to recover the debt. You will be responsible for our reasonable costs of recovery.
4.6 Title in goods does not pass to you until we have received payment in full. Risk in the goods passes to you on delivery or collection, regardless of whether title has passed.
5. Product information, suitability and advice
5.1 We take care to ensure product descriptions, specifications, images and pricing on our website and in our materials are accurate and current, but we do not guarantee they are error-free, and actual products may vary slightly from images (for example due to manufacturer updates or configuration options).
5.2 Where we provide advice or recommendations about product suitability, that advice is general in nature and is not a substitute for a clinical assessment by a qualified occupational therapist, physiotherapist or other treating health professional. Final responsibility for confirming clinical suitability rests with you and your treating health professionals, particularly for prescribed or complex equipment.
5.3 If you or your representative provide us with measurements, medical information, or other specifications for equipment selection or customisation, we rely on that information being accurate and current. We are not responsible for issues arising from inaccurate or outdated information supplied to us.
6. Delivery
6.1 Delivery timeframes provided by Push Mobility are estimates only. They may be affected by manufacturer lead times, freight providers, customisation requirements, and matters outside our control, and are not guaranteed unless expressly agreed in writing.
6.2 You are responsible for providing a suitable and accessible delivery location and for ensuring someone is available to receive delivery, or for arranging collection within a reasonable time of being notified the goods are ready.
6.3 If delivery cannot be completed due to an incorrect address, no one being available to receive goods, or access issues at the delivery location, we may charge a reasonable re-delivery fee.
6.4 To the extent permitted by law, we are not liable for delays or failures in delivery caused by circumstances beyond our reasonable control, including manufacturer or freight provider delays, natural events, or funding approval delays.
7. Equipment trials and demonstrations
7.1 Where we provide a product trial, loan or demonstration, the equipment remains our property at all times. You must take reasonable care of trial equipment and return it in the condition provided (fair wear and tear excepted) by the agreed date.
7.2 You may be responsible for the cost of repair or replacement if trial equipment is lost, stolen, or damaged beyond fair wear and tear while in your care.
7.3 A trial does not guarantee that the product is suitable, that funding will be approved, or that the same configuration will be available for purchase.
8. Cancellations, changes and returns
8.1 Standard stock items: You may cancel an order for standard, unmodified stock items prior to dispatch. Once dispatched or collected, our returns process (clause 8.4) applies.
8.2 Custom and prescribed equipment: Because custom, made-to-order or prescribed equipment is built or configured specifically for you, orders for such equipment cannot generally be cancelled once manufacture or customisation has commenced. Where cancellation is accepted at our discretion after work has commenced, you may be charged for costs already incurred, including materials, labour and any non-returnable components.
8.3 Change of mind: Other than your rights under the Australian Consumer Law (see clause 2), we are not required to accept a change-of-mind return. Where we do accept one at our discretion, the goods must be unused, in original condition and packaging, and a reasonable restocking or handling fee may apply. Change-of-mind returns are not available for custom, made-to-order, or hygiene-sensitive items (such as cushions, slings or items that have had direct skin contact) once used.
8.4 Faulty or incorrect goods: If goods are faulty, not as described, or incorrectly supplied, contact us promptly so we can arrange assessment, repair, replacement or refund in accordance with your rights under clause 2.
8.5 Any refund will be made using the same payment method used for the original purchase, unless otherwise agreed, and after deduction of any amount you legitimately owe us.
9. Warranties and repairs
9.1 Many products we supply carry a manufacturer's warranty. Warranty terms, including duration and what is covered, vary by manufacturer and product and will be provided to you at or before the time of supply where available.
9.2 A manufacturer's warranty operates in addition to, and does not replace or limit, your rights under the Australian Consumer Law.
9.3 Warranty claims may require the equipment to be assessed by us or the manufacturer before a repair, part replacement or other remedy is provided. Reasonable assessment and freight timeframes will apply.
9.4 Warranties generally do not cover fair wear and tear, damage caused by misuse, neglect, unauthorised modification or repair, failure to follow care and maintenance instructions, or accidental damage. We will advise you if an issue you raise appears to fall outside warranty cover, and can provide a quote for a chargeable repair.
10. Servicing and repairs (chargeable work)
10.1 Where you request a service or repair outside of warranty, we will provide a quote before carrying out chargeable work where reasonably practicable. Approving the quote (including verbally or by email) authorises us to proceed.
10.2 If, once work has begun, we discover additional issues not covered by the original quote, we will contact you before carrying out further chargeable work where reasonably practicable.
10.3 Equipment left with us for repair or service that is not collected within a reasonable period after we notify you it is ready (generally 30 days, unless otherwise agreed) may incur reasonable storage fees, and we may take further steps permitted by law in relation to uncollected goods.
11. Website use
11.1 You must not use our website for any unlawful purpose, to transmit harmful code, to attempt unauthorised access to our systems, or in any way that could damage, disable or impair the website or interfere with any other person's use of it.
11.2 All content on our website — including text, images, logos, product photography and design — is owned by or licensed to Push Mobility and is protected by copyright and other intellectual property laws. You may not reproduce, copy, distribute or exploit this content without our prior written consent, other than for your own personal, non-commercial reference.
11.3 We take reasonable care to keep our website accurate and available, but we do not guarantee it will be uninterrupted, error-free, or free of viruses, and we may suspend, withdraw or restrict access to all or part of the website at any time.
11.4 Online payments made through our website may be processed by third-party payment providers in accordance with their own terms and security practices, as described in our Privacy Policy.
12. Liability
12.1 Nothing in this clause 12 limits or excludes any liability that cannot lawfully be limited or excluded, including your rights under the Australian Consumer Law (see clause 2).
12.2 To the maximum extent permitted by law, Push Mobility excludes all liability for indirect, special or consequential loss, or for loss of profits, revenue, data, or business opportunity, arising from or in connection with these Terms or the supply of goods or services, whether in contract, tort (including negligence), or otherwise.
12.3 To the maximum extent permitted by law, and subject to clause 2, our total liability to you arising out of or in connection with an order is limited to the amount you paid for the relevant goods or services giving rise to the liability.
12.4 We are not liable for any loss or damage arising from your failure, or the failure of your representative or treating health professional, to provide accurate information about your needs, measurements, or medical circumstances, or from use of equipment in a way inconsistent with instructions provided or its intended purpose.
13. Indemnity
13.1 To the extent permitted by law, you indemnify Push Mobility against any loss, damage, cost or claim arising from your breach of these Terms, your misuse of any equipment supplied, or inaccurate information you or your representative provide to us, except to the extent caused by our negligence or wrongful act.
14. Privacy and health information
14.1 We collect, use, store and disclose personal information (including health and disability information) in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By providing personal or health information to us, you acknowledge our Privacy Policy applies to that information.
15. Force majeure
15.1 We are not liable for any delay or failure to perform our obligations where that delay or failure results from circumstances beyond our reasonable control, including natural disasters, pandemic-related restrictions, manufacturer or supply chain disruption, transport disruptions, industrial action, or government action.
16. Complaints and disputes

17. General
17.1 Governing law. These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
17.2 Severability. If any part of these Terms is found to be invalid or unenforceable, that part will be read down or severed to the minimum extent necessary, and the remainder of these Terms will continue in effect.
17.3 No waiver. A failure by Push Mobility to enforce any part of these Terms is not a waiver of our right to do so later.
17.4 Entire agreement. These Terms, together with any quote, invoice, or written agreement specific to your order, constitute the entire agreement between you and Push Mobility in relation to your purchase, and supersede any prior discussions, unless expressly stated otherwise in writing.
17.5 Assignment. You may not transfer or assign your rights under these Terms without our written consent. We may assign or transfer our rights and obligations under these Terms, including in connection with a sale or restructure of our business.
